Terms of Use

1. Description of the service

Frankly (frankly.es) is an independent property price analysis platform for Madrid, operated by Frankly Data Lab, S.L. (“Frankly”, “we”, “us”). The service collects residential listings from publicly accessible property portals and agencies, and provides indicative value estimates based on market data.

Access to certain features (detailed price analysis, comparables, downloadable report) requires a paid subscription.

2. Acceptance of terms

By accessing or using Frankly, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree with any of these terms, you must not use the service.

3. Purchases and billing

Listing reports. You may purchase individual listing reports or a Search Pass (30-day access). All purchases are charged at the time of purchase.

Search Pass renewal. If you purchase a Search Pass, it renews automatically each month. The applicable amount will be charged to the payment method you provided at the start of each billing period.

Cancellation. You may cancel your Search Pass at any time from your account. Cancellation takes effect at the end of the current billing period. Individual listing reports are non-refundable once delivered.

Price changes. We will notify you of any subscription price changes by email at least 30 days in advance.

4. Acceptable use

By using Frankly, you agree not to:

• Scrape, bulk-copy, or redistribute the data or analysis provided by the service.
• Use the service for unauthorised commercial purposes, including reselling analysis to third parties.
• Attempt to access restricted areas of the system or circumvent any authentication mechanism.
• Interfere with the normal operation of the service or its servers.
• Use the data to build competing databases.

5. Data accuracy and limitation of liability

Indicative only. The price analyses, value estimates, and comparables provided by Frankly are for informational and guidance purposes only. They do not constitute financial, real estate, or investment advice.

Third-party data. Property information is sourced from public third-party listings. Frankly does not verify the accuracy, currency, or truthfulness of those listings. Prices, sizes, and features may not reflect the actual or current state of a property.

No warranty. Frankly does not guarantee that value estimates reflect the true market price or the price at which a transaction will occur. Buying or selling decisions should be based on your own due diligence and, where appropriate, the advice of qualified professionals.

Limitation of liability. To the maximum extent permitted by applicable law, Frankly shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use the service or the data provided, including financial losses resulting from decisions made on the basis of the analyses offered.

6. Intellectual property

The software, design, analysis methodology, and original content of Frankly are owned by Frankly Data Lab, S.L. and are protected by Spanish and international intellectual property law.

Listing data belongs to its respective owners or original sources. Frankly makes no ownership claim over that data and displays it solely for the purpose of analysis and consumer information, with a link back to the original source in each case.

7. User accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately of any unauthorised use of your account at privacy@frankly.es.

8. Changes to the service

Frankly reserves the right to modify, suspend, or discontinue the service or any of its features at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

9. Changes to these terms

We may update these Terms of Use from time to time. We will notify you of material changes by email or via a prominent notice in the service. Continued use of the service after changes are published constitutes your acceptance of the updated terms.

10. Governing law and jurisdiction

These Terms of Use are governed by Spanish law. For any dispute arising from use of the service, the parties submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may apply to them.
